Terms of Service

Effective May 1, 2026

These Terms of Service (“Terms”) govern your access to and use of washindex.com (the “Site”), the WashIndex platform at platform.washindex.com (the “Platform”), and any related services (collectively, the “Services”) operated by Sparkle Technologies (“WashIndex,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Description of services

WashIndex provides market data, analytics, and tools for the U.S. car wash industry. The Services include the marketing site, the Intelligence Blog, and the WashIndex platform itself, which offers visualization, search, scoring, benchmarking, and AI-assisted querying of our datasets.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract under applicable law to use the Services. If you create an account on the Platform, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3. License to use

Subject to your compliance with these Terms, WashIndex grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal evaluation purposes. Any other use requires our prior written consent.

4. Data and intellectual property

All content, software, data, designs, text, graphics, and the selection, coordination, and arrangement thereof on the Services are owned by Sparkle Technologies, our licensors, or our data providers, and are protected by U.S. and international intellectual property laws.

You may not, except as expressly permitted by us in writing:

  • Copy, reproduce, modify, or create derivative works of the Services or our datasets.
  • Republish, redistribute, sublicense, sell, or rent any portion of the Services or our datasets.
  • Scrape, crawl, or use automated means to extract data from the Services beyond ordinary browser usage.
  • Use the Services to develop a competing product.
  • Remove, obscure, or alter any proprietary notices.

5. Acceptable use

You agree not to:

  • Use the Services in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the Services, other accounts, or related systems.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Submit content that is unlawful, infringing, defamatory, or otherwise objectionable.
  • Use the Services to harass, abuse, or harm another person.

6. Third-party content

The Services display data derived from third-party sources, including Google Reviews, U.S. Census Bureau data, state and federal departments of transportation, and operator websites. We make commercially reasonable efforts to keep this data accurate and current, but it is provided “as is” and you should not rely on it as the sole basis for material business decisions.

7. AI-generated outputs

The Platform includes AI features (including the Ask AI chat panel and AI review categorization) that produce automatically generated outputs. These outputs may contain inaccuracies and should be verified before being relied upon. You are responsible for evaluating the accuracy, completeness, and usefulness of any AI-generated content for your purposes.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. NOTHING IN THE SERVICES CONSTITUTES INVESTMENT, LEGAL, FINANCIAL, OR REAL-ESTATE ADVICE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WASHINDEX AND SPARKLE TECHNOLOGIES (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless WashIndex and Sparkle Technologies from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or your misuse of the Services.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for any violation of these Terms. Upon termination, your right to use the Services will immediately cease. Sections 4, 8, 9, 10, 11, 12, and 13 will survive termination.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the “Effective” date at the top. Material changes will be communicated via the Site, where appropriate. Continued use of the Services after a change constitutes acceptance of the updated Terms.
